WONE'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER OR RELATING TO THESE TERMS SHALL BE STRICTLY LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO WONE UNDER YOUR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD 100.00).
These Terms and any dispute, controversy, or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.
Any dispute, controversy or claim arising out of or in connection with these Terms, including any question regarding its existence, validity, interpretation, performance, breach or termination, shall be referred to and finally resolved by arbitration under the London Court of International Arbitration (LCIA) Rules, which Rules are deemed to be incorporated by reference into this clause.
The number of arbitrators shall be one (or three where the dispute exceeds USD 1,000,000). The seat, or legal place, of arbitration shall be London, United Kingdom. The language to be used in the arbitral proceedings shall be English. For institutional matters specifically concerning the GCC region, the parties may mutually elect in writing to submit disputes to the jurisdiction of the Dubai International Arbitration Centre (DIAC) or the DIFC Courts in Dubai, United Arab Emirates.
